AWAKEN FILM PROJECT - TALENT RELEASE

TERMS & CONDITIONS

Entity: The “Awaken” Lyric Video Project [thelukasband (Luke Munns)/BackHome (Jessie Skelly)]

Production: “Awaken” Lyric Video Project.

0.1. Subject to clause 0.4 and In consideration of Awaken including my Performance (defined below) into the Production I warrant, confirm and agree with Awaken that:

(a) Awaken shall have the right to exploit my name, likeness, voice, performance contribution, biography and any literary, dramatic, musical or artistic work created or adapted by me or performed by me, whether or not in collaboration with others which is featured in the Production (Performance);

(b) Awaken may include the Performance in the Production and by the exploitation of the Production and excerpts from it and trailers for it in any and all media by any manner or means whether now known or invented in future throughout the world for the full period of copyright in the Production including all renewals, revivals, reversions and extensions;

(c) I irrevocably and unconditionally license to Awaken all rights in respect of my Performance in the Production and I irrevocably and unconditionally give and confirm to Awaken, its successors, licensees and assignees all consents required pursuant to the Copyright Act, 1968 and all other consents required pursuant to any other legislation now known or in the future enacted under the laws in force in any part of the world to authorise the exploitation of the Production in accordance with the provisions of paragraph 1.1(a);

(d) I irrevocably and unconditionally waive all moral rights to which I am now or may in the future be entitled in respect of the inclusion of my Performance in the Production or to the extent permissible pursuant to any other legislation now or in future enacted under the laws in force in any part of the world.

0.2. I acknowledge that Awaken owns and shall own all rights (including copyright) in the Production. I assign to Awaken all rights (including without limitation all present and future copyright throughout the world and in perpetuity) in the Production which might, but for this Agreement, vest in me.

0.3. I acknowledge that I have agreed to participate in the Production and give my Performance on a voluntary basis and that the use of my Performance and the Production does not give me any right to require payment or participation in the proceeds of the exploitation of the Performance and Production.

0.4. I give consent for the collection, storage, use and processing of any data necessary for the performance of this Agreement and/or to enable the parties to comply with any legal obligation upon us or and/or licensees.

0.5. Where I am making this submission of the Performance on behalf of a group or other people who appear in the Performance, I warrant that I have the rights and permissions from all other people who feature in the Performance to enable me to grant the rights set out in this release on behalf of all people in my Performance, as if each person had granted the rights and made the promises set out in this release to Awaken themselves.

0.6. This Agreement is governed by the laws of New South Wales, Australia. The parties submit to the exclusive jurisdiction of the courts of New South Wales.
